Welcome to Whisper Shine Express Car Wash (“Whisper Shine,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website at www.whispershinecarwash.com and your use of our car wash facilities and services located at 3117 Service Rd, Ceres, CA 95307, serving customers from Ceres, Modesto, Bystrom, Turlock, Keyes, and surrounding areas.
By accessing our website, entering our premises, or purchasing our services, you agree to these Terms. If you do not agree, do not use our website or services.
1. About Our Services
Whisper Shine provides express car wash packages, optional Full Service offerings, vacuum access as advertised, and unlimited monthly wash memberships subject to availability and the rules below. Service descriptions, prices, hours, and promotions shown online or on-site are informational and may change without notice.
2. Eligibility and Acceptance
- You must be able to form a binding contract under applicable law to purchase services or memberships.
- You are responsible for ensuring that anyone using our facilities with you complies with these Terms and posted on-site instructions.
- We may refuse service, cancel memberships, or restrict website access for violation of these Terms, unsafe conduct, or fraudulent activity.
3. Website Use
You agree to use the website only for lawful purposes. You must not:
- Attempt to gain unauthorized access to systems, data, or accounts
- Interfere with or disrupt the website, servers, or networks
- Scrape, harvest, or misuse content or contact information
- Upload or transmit malware, spam, or harmful code
- Misrepresent your identity or affiliation with Whisper Shine
- Use the website in any way that violates applicable law

4. Pricing, Payments, and Promotions
- Prices displayed on the website, menu boards, or promotional materials are subject to change and may differ from final on-site pricing.
- Taxes, fees, or surcharges may apply where required.
- Payment methods accepted are those presented at the point of sale or membership enrollment.
- Promotions, discounts, and “Free Vacs” or similar offers are subject to stated conditions, availability, and fair-use limits.
- We are not responsible for typographical errors in pricing; we may cancel or correct transactions affected by obvious errors.
5. Unlimited Wash Memberships
If you enroll in an Unlimited Wash Club or similar membership:
- Memberships are billed according to the plan you select (for example, monthly) and the terms presented at signup.
- Unlimited plans are intended for reasonable personal use of the enrolled vehicle(s) specified at signup, unless otherwise stated in writing.
- Abuse, commercial misuse, sharing credentials/tags beyond allowed vehicles, or fraudulent activity may result in suspension or cancellation without refund to the extent permitted by law.
- Cancellation, pause, refund, and renewal rules are those disclosed at enrollment or on your membership agreement. Contact us at (209) 566-8998 for membership assistance.
- We may modify membership benefits or pricing with notice as required by law or your agreement.
6. Full Service and Express Wash Rules
For your safety and the protection of equipment and vehicles, you agree to follow all posted instructions, including without limitation:
- Hands off the steering wheel and remain in neutral/park as instructed for conveyor washes
- Feet off pedals during the wash tunnel process when required
- Turn wipers off and secure or remove antennas, loose moldings, magnets, spoilers, and other accessories as directed
- Empty truck beds of loose items before entering
- Observe height clearance limits (posted on site) and do not enter with oversized or incompatible vehicles
- Follow staff directions and lane signage at all times
Full Service (where available) may include vacuuming, window wiping, and towel drying as advertised. Availability, timing, and inclusions may vary. Express washes and Full Service results can be affected by vehicle condition, weather, water quality, prior damage, aftermarket parts, and other factors outside our control.
7. Vehicle Condition and Assumption of Risk
Car wash equipment involves mechanical brushes, high-pressure water, chemicals, conveyors, and drying systems. By using our facilities you acknowledge inherent risks associated with automatic and manual wash processes.
- Inspect your vehicle before and after the wash. Notify staff immediately of any concern.
- Vehicles with existing damage, loose parts, poorly attached trim, non-factory accessories, ceramic coatings with special care requirements, convertible tops, or prior repairs may be at higher risk. You are responsible for deciding whether your vehicle is suitable for an express tunnel wash.
- To the fullest extent permitted by California law, Whisper Shine is not liable for damage arising from pre-existing conditions, aftermarket parts, failure to follow instructions, or acts outside our reasonable control.
- Nothing in these Terms limits liability for gross negligence, willful misconduct, or other liability that cannot be limited under applicable law.
8. Conduct on Premises
You agree not to engage in unsafe, disruptive, abusive, or illegal conduct on our property. We may ask anyone to leave and may involve law enforcement when appropriate. Smoking, open flames, and hazardous materials are prohibited except as allowed by posted rules and law.
9. Hours of Operation
Our advertised hours are Daily 7:00 AM – 9:00 PM, subject to change due to weather, maintenance, holidays, emergencies, or operational needs. Closing early or temporary suspensions may occur without prior website notice.
10. Third-Party Links and Social Media
Our website may link to third-party services including our Google Business Profile, Instagram, and Facebook pages. We do not control and are not responsible for third-party content, policies, or practices.
11. Disclaimers
THE WEBSITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT WASH RESULTS WILL MEET EVERY EXPECTATION UNDER ALL CONDITIONS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHISPER SHINE AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE WEBSITE OR SERVICES. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS PRECEDING THE CLAIM, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
13. Indemnification
You agree to defend, indemnify, and hold harmless Whisper Shine and its owners, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the website or facilities, violation of these Terms, or violation of any law or third-party right, to the extent permitted by law.

16. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Except where prohibited, you agree that exclusive venue for disputes arising from these Terms or our services shall be in the state or federal courts located in Stanislaus County, California, and you consent to personal jurisdiction there. You and Whisper Shine agree to attempt to resolve disputes informally by contacting us before filing a claim.
17. Changes to These Terms
We may update these Terms at any time by posting a revised version on this page with an updated “Last updated” date. Continued use of the website or services after changes constitutes acceptance of the revised Terms, except where additional consent is required by law.
18. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. These Terms, together with the Privacy Policy and any membership or service-specific agreements, constitute the entire agreement between you and Whisper Shine regarding the website and general facility use, and supersede prior conflicting understandings on those subjects.
